General Terms and Conditions (GTC)

§ 1 Scope and Contracting Parties

(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts for the 6-week programme and related consulting services concluded between Flamingo Ventures UG (haftungsbeschränkt), Brunnenstr. 42, 10115 Berlin (hereinafter "Provider") and clients (hereinafter "Client").

(2) The contracting partner is Laura Jacobi.

§ 2 Scope of Services, Introductory Call, and Important Disclaimer

(1) The Provider offers consulting services in the areas of health prevention, lifestyle, nutrition, and longevity (longevity consulting). The core element is a structured 6-week programme.

(2) Prior to booking the programme, a complimentary 15-minute introductory call takes place. This call is intended to jointly determine whether the programme is suitable for the Client and to enable the Client to make an informed purchasing decision. No consulting takes place during this call.

(3) IMPORTANT LEGAL NOTICE: The Provider's consulting does not constitute and does not replace medical treatment or diagnosis. The Provider does not make any promises of healing or guarantees of results at any time. The advice is purely intended for lifestyle optimisation (lifestyle consulting).

(4) In the event of serious physical or psychological complaints, or any uncertainty regarding the recommendations, the Client is responsible for independently seeking qualified medical advice.

§ 3 Blood Tests and Supplement Recommendations

(1) As part of the programme, recommendations for dietary supplements are made. These are based on the results of blood tests evaluated by accredited specialist laboratories.

(2) The costs of blood tests are not included in the price of the 6-week programme. Laboratory costs are billed directly between the Client and the respective laboratory.

(3) The Provider does not guarantee reimbursement of laboratory costs by private health insurers (PKV) or benefit offices. Submitting claims and clarifying cost coverage is the sole responsibility of the Client.

§ 4 Prices, Payment Terms, and Advance Payment

(1) The fee for the 6-week programme is €1,800.00 (inclusive of statutory VAT).

(2) Payment is due in full in advance. The right to attend consulting sessions or access programme content only arises upon receipt of full payment.

(3) Payment may be made by bank transfer, credit card, PayPal, or Stripe.

§ 4a Cancellation and Withdrawal Conditions

(1) Cancellation or withdrawal from a binding programme booking is free of charge up to 48 hours before the first official consulting session. In this case, the amount paid will be refunded in full.

(2) In the event of a cancellation made less than 48 hours before the agreed appointment, or if the Client discontinues the programme at a later stage, no refund of the fee will be given. The Provider retains the right to full payment, as the capacity was bindingly reserved for the Client.

§ 5 Client's Duty to Cooperate and Personal Responsibility

(1) The Client bears full and sole responsibility for the practical implementation of the content discussed, any dietary adjustments, and the intake of recommended dietary supplements.

(2) The Client is obliged to truthfully and completely disclose all health-related information that serves as the basis for blood tests and recommendations (e.g. existing allergies, intolerances, or current medications).

§ 6 Limitation of Liability

(1) The Provider delivers services exclusively in the field of lifestyle and prevention coaching. Since the actual implementation of the recommendations lies outside the Provider's sphere of influence, any liability for the achievement of a specific health or physical outcome is excluded.

(2) The Provider accepts no liability for damages arising from the Client's incorrect or incomplete disclosure of pre-existing health conditions.

(3) In all other respects, the Provider's liability is unlimited only for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty, as well as for other damages caused by gross negligence or intent. Liability for minor negligence is excluded to the extent permitted by law.

§ 7 Confidentiality and Data Protection

(1) The Provider guarantees absolute confidentiality. All personal, laboratory, and health-related data obtained in the course of the consultation is protected to the highest standard.

(2) Data is used exclusively within the practice and is not accessible to unauthorized third parties. Further details are governed by the separate Privacy Policy.

§ 8 Final Provisions

(1) The law of the Federal Republic of Germany applies.

(2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.

(3) The place of jurisdiction for all disputes is Berlin.
